Commack man indicted for hacking

A 21-year-old Commack man has been indicted by a Suffolk County Grand
Jury on first degree Computer Tampering charges. Brian J. Bruns will be
arraigned Thursday, June 27 before Judge Joseph Farneti in Riverhead.

The Suffolk County Police Computer Crime Unit arrested Bruns for
disrupting the business operations of his former employer and the
firm's clients. The company, Access Highway in Central Islip, fired
Bruns on May 17 and soon experienced problems in its delivery of
Internet and other services to several clients.

Two search warrants were executed at Bruns home at 84 Florida Avenue.
Police found pirated computer software and other evidence in the house.
The charge of Computer Tampering alleges that Brun intentionally
altered computer data essential to the operation of networks systems
operated by Access Highway. Brun's alleged hacking damaged Access
Highway's operations costing the firm, according to the indictment,
over $50,000 in damages.

First degree Computer Tampering is a felony punishable by a prison term
of 7 and one-half to 15 years. Brun was also charged with Criminal
Mischief in the second degree, a D felony carrying a prison term of 3
and one-half to 7 years.

Bruns made a "Plea Bargain With The DA" . Only indictment 1577.02 was
dismissed and he plead out to a lesser Class E Felony (Crime 156.30) on
Indictment 2423-02 and waived his right to appeal as part of the plea.
Date of disposition 12/02/2002. Five years probation, no alcohol,
narcotics, mandatory surcharge waived, etc and all acknowledged by
DEFENDANT! So, if anyone has proof of probation violations, contact
Officer Benedetto at 631-852-5084.

Yes, Robert Griffin is a wimp. He is a man above the laws. He filed 26

Patrick, feel free to use the two affidavits that I sent to you in your
legal matters against Griffin.

We, Griffin's victims also should consider to sue him in a class action

Griffin accept just one kind of free speech and that is his own. He

I saw a thief get tackled by Save-On Foods employees last night on
King George Hwy. One of them was an undercover employee and the big
longhair tripped and was caught. Good. I was at Safeway last year and
a woman had her groceries stolen from her in the parking lot.

The Plaintiff stalks his victims by filing numerous frivolous
complaints with law enforcement on a world wide scale. The Plaintiff
does this to intimidate, harass and humiliate people who the Plaintiff
has had disagreements with on the Internet and Usenet newsgroups. The
Plaintiff, while using his admitted name of "Magnus Pym" with the
e-mail address of "***@hushmail.com" and his other alias of
"Bob Griffin" with the e-mail address of
"***@hotmail.com" has published to the Internet
and to Usenet newsgroups the following harassing and threatening
"words" as printed below and labeled as (a), (b), (c), (d), (e),
(f) (g) and (h).

(a) "Jurarez is also under FBI investigation for the stalking and
harrassment of the
original proponent. An FBI File Number is

a cost of to the Defendant $50.00 Canadian. Also, the Defendant has now
had to make his telephone unlisted for fear of future harassment from
the Plaintiff, or from the Plaintiff's harassing and abusive
associates.

27. Furthermore, after the Plaintiff published on the Internet and
newsgroups the full name, home address and telephone of the Defendant,
the Defendant received posted Internet and Usenet newsgroup threats of
physical violence and also of harassment from other Internet and Usenet
newsgroup users, as printed below and labeled as (a), (b), (c) and (d).

Do you realize that if you really are taken to court over this, the court will
have access to googlegroups and will be able to determine fairly quickly who
started what? I'm not saying the version of the story you keep posting isn't
accurate, I'm saying it doesn't matter if it is or not, but you'd better hope
it is because if you left out any references to posts in your timeline, the
court will find them. This isn't a case of your word against his, this is a
case that will come down to evidence documented by an impartial third party
(Google).

in my opinion, the person who started this whole war was robert, but
of course his take on the story would be, "doug started it!"

robert literally turned ASH against himself to the point of someone
ousting him like he had done to more than a handful of people for the
months prior to his ousting, which was done thru an anonymous remailer
in true magnus pym style.

I got a harassing e-mail in true Barbara Schwarz style in January and in
German after someone outed me with my full address and phone number in
ASH and ASM.

Does RG know any German?

But Barbara does, go figure. And the e-mail in English that I got was
Patrick Sullivan jargon. And I have been able to find out about his hate
and verbal brutality against me lately. He has no empathy, no scruples.

Weird enough that someone deleted the posts that outed me...

Maybe I was in the way of the "Christian" Doug Wiser who feared to be
revealed as what he is by me? There is not much Christian background to
be seen in his actions.

and then "blacked out" the important parts. And unknown to the
Nanaimo RCMP, and to publicly humiliate the Defendant, the Plaintiff
created a website to publish the "doctored" RCMP letter, which the
Nanaimo RCMP mailed to the Plaintiff. The website link is below,

entitled "The Douglas Wiser FAQ". This website sponsors hatred,
harassment and defames the Defendant and also publicly harasses and

which the Plaintiff created, is labeled as (g).

The Plaintiff stalks his victims by filing numerous frivolous
complaints with law enforcement on a world wide scale. The Plaintiff
does this to intimidate, harass and humiliate people who the Plaintiff
has had disagreements with on the Internet and Usenet newsgroups. The
Plaintiff, while using his admitted name of "Magnus Pym" with the
e-mail address of "***@hushmail.com" and his other alias of
"Bob Griffin" with the e-mail address of
"***@hotmail.com" has published to the Internet
and to Usenet newsgroups the following harassing and threatening
"words" as printed below and labeled as (a), (b), (c), (d), (e),
(f) (g) and (h).

(a) "Jurarez is also under FBI investigation for the stalking
and
harrassment of the
original proponent. An FBI File Number is

telephone of the Defendant on the Internet and newsgroups, the
Defendant began to receive telephone calls from strangers. Some of the
telephone calls were verbally threatening in nature. The Defendant had
to change his telephone number, because of the telephone harassment, at
a cost of to the Defendant $50.00 Canadian. Also, the Defendant has now
had to make his telephone unlisted for fear of future harassment from
the Plaintiff, or from the Plaintiff's harassing and abusive
associates.

27. Furthermore, after the Plaintiff published on the Internet and
newsgroups the full name, home address and telephone of the Defendant,
the Defendant received posted Internet and Usenet newsgroup threats of
physical violence and also of harassment from other Internet and Usenet
newsgroup users, as printed below and labeled as (a), (b), (c) and (d).

man move so fast. If I had a wrench in my hand, it may have very well

a bit of a coward like you, the the way he scurried his fat ass into
his van after he said "FUCK YOU", then rolled up the window and hid
when I went after him to see who he was and what he wanted leaving a
letter on my auto. Then as he was driving down the street he got
couragous again and hurled some utterances out the window of his van.

It really appears that even the people you have do your filthy bidding

In most respects I'd agree, and I would think that would be his lawyer's advice
as well. But in this case continuing to talk about it here seems to be
resulting in the defendant digging a deeper hole for himself (throwing a spazz
when served, then posting about fantasizing about hitting the process server
with a wrench!). Conversely, there's nothing in the plaintiff's recent
postings that undermine himself. So in this case, perhaps the plaintiff's
decision to keep talking about it is shrewd, but admittedly, it's a dangerous
tactic.

By the way, I doubt the court will entertain the existence of the concept of a
'typical usenet kook-exchange'. The court will look at it as an exchange
like any other between two adults regardless of who is considered 'kooky' on
usenet. The only times the court will refuse to hear a case between parties is
when disputes arise from a consensual criminal endevour.

Maybe, it's hard to say. I'd STFU if I were him, but I'm not so sure it's that
important. Personally I'd rather be safe than sorry. It's possible the
plaintiff isn't expecting to win and is only launching the lawsuit as a means
of harassment.

Mr. Pope ought to note the posts by BLOU, Barbara Schwarz, etc -- which

October last year.

Not so; I am launching the lawsuit to *end* my harassment, as I aver
the Defendant has been questioned by police, told to stop *by* police,
and PMS carried on regardless. I also aver I stopped posting or reading
usenet for months at a time, yet the defamation and the websites and
the libel kept spewing out from the defendant.

Sounds reasonable, if you are continuing to be libelled, it would be
reasonable for you to respond to refute the allegation each time it is made.
If you continue the exchange after refuting the libel, then perhaps you will
have been 'baited', rather than being the one doing the baiting, as alleged by
gapope.

stalking laws in some jurisdictions, and evidence of 'cyberstalking' would
simply be evidence entered into a stalking trial. The slander/libel and
criminal harassment charges are far more likely to be successful than a
stalking charge would be, in my opinion. The fact that the plaintiff continues
to talk publically about it doesn't really have any bearing on the case,
because if what he alleges convinces the court, then the court should decide
that he should be able to post publically on usenet whenever he wants about
whatever he wants without being criminally harassed.

Then you were not properly served. In a first world country (USA), a
person who is the subject of legal proceedings needs to be properly
informed of those proceedings. What if those papers on your windshield
blew away, or were damaged and made illegible? What if you thought he
was placing advertising on your car, and you threw it away unread? Why,
you would have no knowledge of legal proceedings underway that involved
you.

So, ask yourself this....

Is "I didn't know about this case" a valid defense in court?

The answer is "no", because there are procedures to be followed for the
service of legal papers. They must be physically given to the person
being sued, and that person must be informed that they have been served
legal documents. In your case, it doesn't sound like that standard was met.

Ask yourself why.....

Actually the process server just has to make a good faith attempt to
serve with the reasonable assumption that the intended person got the
papers. A co-worker of mine would hide every time the process server
came to our place of work to serve him. He finally just threw the
papers on the third occasion onto the floor of the business and left.
They were accepted as having been served because he had been present
at work that day.

In any case why doesn't the interested party just scan and post the
legal papers here assuming this is a Lower Mainland resident.
