CHICAGO (CBS) — Jussie Smollett paid two brothers to stage an attack against him, directed them to buy items used in the alleged assault and actually rehearsed it with them, sources say.

Sources say at least one of the brothers bought the rope used in the incident at Smollett’s request. The sources also say the “Empire” actor paid for the rope, which was purchased at the Crafty Beaver Hardware Store in the Ravenswood neighborhood the weekend of Jan. 25.

The brothers, who were questioned by police this week before being released, were paid $3,500 before leaving for Nigeria and were promised an additional $500 upon their return.

They left for Nigeria later in the day on Jan. 29, after the attack.

Sources said one of the brothers held the rope and poured bleach while the other wore a plain red hat and yelled slurs at Smollett.

The sources say the red hat was bought at an Uptown beauty supply store and that the attack was supposed to happen before Jan. 29. The brothers told detectives the three men rehearsed the attack days prior to it happening.

Smollett claims two men attacked him in Streeterville early Jan. 29 as he was heading to his apartment. He said they yelled racial and homophobic slurs at him, poured a chemical on him and put a rope around his neck.

The brothers are now cooperating with police.

Since being released Friday night, the brothers have been staying in an undisclosed location.

Chicago police spokesperson Anthony Guglielmi said:

“We can confirm that the information received from the individuals questioned by police earlier in the Empire case has in fact shifted the trajectory of the investigation. We’ve reached out to the Empire cast member’s attorney to request a follow-up interview.”

Police raided the the brothers’ home on Wednesday, the same day police met them at O’Hare International Airport, as they were returning from Nigeria.

The two were in custody at Area Central detective headquarters since Wednesday night, before they were released on Friday evening.

Police at one point had placed them under arrest and referred to them as suspects in the case. Then, after interviews on Friday, they were released.

Pictures from the raid show the front door busted off its frame, items thrown across the living room, bedroom doors damaged and clothes tossed everywhere.

Police left behind an inventory list. Some of the items seized include a black face mask hat, an Empire script, phone, receipts, a red hat and bleach.

CBS 2’s Brad Edwards reported Thursday that a source with intimate knowledge of the investigation said investigators believe Jussie Smollett “potentially staged the attack.”

Smollett’s attorneys, Todd S. Pugh and Victor P. Henderson, released a statement Saturday about the latest allegations.

“As a victim of a hate crime who has cooperated with the police investigation, Jussie Smollett is angered and devastated by recent reports that the perpetrators are individuals he is familiar with. He has now been further victimized by claims attributed to these alleged perpetrators that Jussie played a role in his own attack. Nothing is further from the truth and anyone claiming otherwise is lying.

“One of these purported suspects was Jussie’s personal trainer who he hired to ready him physically for a music video. It is impossible to believe that this person could have played a role in the crime against Jussie or would falsely claim Jussie’s complicity.

Special prosecutor Dan Webb has indicted actor Jussie Smollett in connection with a hate crime hoax that he was accused of staging last January.

“The Cook County Clerk’s Office confirmed Tuesday that special prosecutor Dan Webb has indicted former ‘Empire’ actor Jussie Smollett in connection with the alleged attack,” ABC 7 reported. “Smollett had been charged with 16 counts of felony disorderly conduct for allegedly lying to police about the alleged attack, which police say Smollett staged on himself because he was unhappy with his ‘Empire’ salary.”

ABC 7 reporter Rob Elgas later added that Webb’s office said in a statement: “a Cook County grand jury returned a six-count indictment charging Jussie Smollett with making four separate false reports to Chicago Police Department officers related to his false claims that he was the victim of a hate crime…”

Fox 4 noted that prosecutors had insisted last year that “Smollett faked the racist, anti-gay attack on himself in the hopes that the attention would advance his acting career.”

“But with little explanation, authorities in March of 2019 abruptly dropped all charges against Smollett, abandoning the criminal case only five weeks after the allegations were filed. In return, prosecutors said, the actor agreed to let the city keep his $10,000 in bail,” Fox 4 added. “The dismissal drew a swift backlash from the mayor and police chief and raised questions about why Smollett was not forced to admit what prosecutors had said they could prove in court – that the entire episode was a publicity stunt.”

The development comes after a Cook County judge recently ordered Google to turn over nearly all of Smollett’s data from the last year.

“The warrants, filed last month in Circuit Court, sought a trove of documentation from Smollett and his manager’s Google accounts — not just emails but also drafted and deleted messages; any files in their Google Drive cloud storage services; any Google Voice texts, calls and contacts; search and web browsing history; and location data,” The Chicago Tribune reported. “Authorities could be looking for any incriminating remarks from Smollett or his manager, especially in the months after State’s Attorney Kim Foxx’s office abruptly dismissed disorderly conduct charges against the then-‘Empire’ actor just weeks after his indictment.”

Numerous top officials weighed blasted Cook County State’s Attorney’s office after it had dropped all charges against Smollett.

“I’m sure we all know what occurred this morning,” then-Chicago Police Superintendent Eddie Johnson said. “My personal opinion is that you all know where I stand on this. Do I think justice was served? No.”

“Where do I think justice is?” Johnson continued. “I think this city is still owed an apology. … When I came on this job, I came on with my honor, my integrity and my reputation. And if someone accused me of doing anything that would circumvent that, then I would want my day in court. Period. To clear my name.”

“I’ve heard that they wanted their day in court with TV cameras so America could know the truth,” Johnson added. “And now they chose to hide behind secrecy and broker a deal to circumvent the judicial system.”

Then-Democrat Chicago Mayor Rahm Emanuel expressed even more anger with his comments on Smollett.

“This is a whitewash of justice,” Emanuel said. “A grand jury could not have been clearer.”

“You cannot have, because of a person’s position, one set of rules apply to them and another set of rules apply to everybody else,” Emanuel continued. “In another way, you’re seeing this play out in the universities, where people pay extra to get their kids a special position in universities. Now you have a person, because of their position and background, who’s getting treated in a way that nobody else would ever that would ever get close to this type of treatment.”

“The city saw its reputation dragged through the mud,” Emanuel added. “This is without of doubt a whitewash of justice and sends a clear message that if you’re in a position of influence and power, you’ll get treated one way, other people will be treated another way. There is no accountability in the system. It is wrong, full stop.”

“I wanted to say one other thing,” Emanuel said. “Mr. Smollett is still saying that he is innocent, still running down the Chicago Police Department.”

“How dare he! How dare him! After everybody saw — and I want to remind you — this is not the superintendent’s word against his,” Emanuel continued. “The grand jury, a sliver of the evidence and they came to a conclusion, as did the state’s attorney’s office. This is not the superintendent and the detectives, department, word against his!”

“And even after this whitewash, still, no sense of ownership of what he’s done. He says that in fact he is the wronged in this case,” Emanuel added. “This is an unbelievable, not just whitewash of justice, this a person now that’s been let off scot-free, with no sense of accountability of the moral and ethical wrong of his actions, from top to bottom, not only to tarnish the name of the city.”

“But then I cannot stress that in a time when you have people bringing a moral equivalency in Virginia between bigots and those fighting bigotry, and you have a person using hate crime laws that are on the books to protect people, who are minorities, from violence, to then turn around and use those laws to advance your career and your financial reward,” Emanuel concluded. “Is there no decency in this man?”

CHICAGO (AP) — Actor Jussie Smollett was indicted Tuesday for a second time on charges of lying to police about a racist and anti-gay attack he allegedly staged on himself in downtown Chicago, renewing a divisive criminal case that drew worldwide attention last year.

The indictment came from a special prosecutor who was appointed after Cook County prosecutors dropped the same charges last March.

The new charges were sure to reignite many of the tensions that surrounded Smollett a year ago. When his claims first emerged, he drew a groundswell of support from fans and celebrities and gave an emotional television interview about the attack.

The case came to reflect the polarized state of political discourse in America. Many Democrats initially called it a shocking instance of Trump-era racism and hate, while Republicans depicted it as yet another example of liberals rushing to judgment and disparaging the president’s supporters as bigots.

Special prosecutor Dan Webb said in a statement that Smollett faces six felony counts of disorderly conduct, charges that stem from four separate false reports that he gave to police in which he contended he was a victim of a hate crime “knowing that he was not the victim of a crime.”

The statement immediately raised questions about county prosecutors’ decision to drop the charges and made it clear that those prosecutors had not adequately explained to special prosecutors why they did so. But Webb stressed that he had reached no conclusions about whether anyone involved in the case had engaged in any wrongdoing.

Smollett, who is black and gay, was originally charged with disorderly conduct in February 2019 for allegedly staging the attack and lying about it to investigators. The allegations were dropped the following month with little explanation, angering police officials and then-Mayor Rahm Emanuel.

Tina Glandian, Smollett’s attorney, questioned Webb’s decision to file new charges.

The indictment “raises serious questions about the integrity of the investigation that led to the renewed charges” Glandian said, citing the use of the same detectives who were part of the original investigation into the attack to conduct the latest probe, despite Smollett’s pending civil claims against the city and police officers for malicious prosecution.

He is scheduled to appear in court for arraignment on Feb. 24.

Smollett told police he was walking home early on Jan. 29, 2019, when two masked men approached him, made racist and homophobic insults, beat him and looped a noose around his neck before fleeing. He said his assailants, at least one of whom he described as white, told him he was in “MAGA country” — a reference to President Donald Trump’s campaign slogan, “Make America Great Again.”

Several weeks later, authorities alleged that Smollett had paid two black friends $3,500 to help him stage the attack because he was unhappy with his salary as an actor on “Empire,” a Fox series about that follows a black family as they navigate the ups and downs of the recording industry. Smollett was accused of using the scheme to drum up publicity for his career.

A judge in August appointed Webb, a former U.S. attorney, to look into why the original charges were dropped. Webb also was investigating whether phone calls that Cook County State’s Attorney Kim Foxx had with a Smollett relative and a former aide of former first lady Michelle Obama unduly influenced the decision to drop charges. Foxx recused herself from the case but continued to weigh in.

At the time, Judge Michael Toomin, who assigned the case to Webb, raised the possibility that Smollett could be charged again. According to the judge and attorneys, double jeopardy does not apply because Smollett was never prosecuted.

In his news release, Webb said he concluded that prosecuting Smollett was “in the interest of justice” for a number of reasons, including the extensive details of Smollett’s false account as well as the resources that the police department threw at the investigation.

When the first indictment against Smollett was returned, Webb wrote, the state’s attorney’s office had concluded that the evidence in the case was “strong.” But the office failed to offer any new evidence to explain why authorities dropped the charges just a few weeks later, Webb said.

Further, Webb took issue with an assertion in a news release issued when the charges were dropped that Smollett had not received special treatment and that the case was resolved “under the same criteria that would be available for any defendant with similar circumstances.” Webb asked for but never received any examples of other such cases, he wrote.

The city has sued Smollett, seeking reimbursement of more than $130,000 for overtime paid to officers who were involved in investigating Smollett’s report. Smollett’s attorneys have said the city should not be allowed to recover costs from Smollett because it accepted $10,000 from the actor “as payment in full in connection with the dismissal of the charges against him.”

It was not immediately clear what sentence Smollett faces if convicted. When he was originally charged with disorderly conduct, it was reported that he could be placed on probation or sent to prison for one to three years per count.

Smollett’s case has become an issue in Foxx’s bid for a second term. Those looking to unseat the first black woman to hold the county’s highest law enforcement position, have blasted her handling of the matter as haphazard and indecisive. They say it indicates she has bad judgment and favors the rich and powerful in deciding who will be prosecuted.

Foxx’s campaign committee issued a biting statement Tuesday referring to former FBI Director James Comey’s decision to briefly reopen an investigation into Democratic candidate Hillary Clinton’s email shortly before the presidential election in 2016 that Donald Trump would win.

“What’s questionable here is the James Comey-like timing of that charging decision”…which can only be interpreted as the further politicization of the justice system, something voters in the era of Donald Trump should consider offensive,” the statement from Friends for Foxx said.

Smollett’s attorney also raised political implications.

The attempt to re-prosecute Smollett “on the eve of the Cook County State’s Attorney election is clearly all about politics not justice,” she said.

Smollett, 37, has not had any notable film or television roles announced since his departure from the TV series was made public in April 2019. Producers have the option to bring him back during the sixth and final season but have said they have no plans to do so.

“Empire” has 10 episodes left. It is scheduled to return March 3.
