<In addition, a special provision in the Indian constitution (article 370)
enables the state government to prohibit purchase of land, in the Muslim
majority area, by Hindus from other parts of India.>
My dear Carlos,
You posted the article (including the excerpt aboove) under which you added
Jai Hind. Does this mean you agree with all the article says ?
Here are a few questions I ask. If you know the answers, please enlighten us
.... we can continue the debate privately ...if you wish
1. Have you read Article 370 of the Indian Constitution? Does it "enable the
state government to prohibit purchase of land, in the Muslim majority area,
by HINDUS from other parts of India"
1b. Are you (assuming that you are a Christian) can BUY property in Kashmir?
2. Is Kashmir a disputed area? If so why?
2b. What were the terms agreed upon for the Accession of Kashmir?
2c. Was that a Contract?
2d. Is it OK to modify the terms of a contract without the consent of BOTH
of the parties?
2e. What has been the decision of the Kashmir Legislature wrt Art 370?
2f. In a democracy, what role does the State Legislature have in deciding
the future of a people?
3. In Kashmir, is it true that the people would like to preserve the
Kashmiriness of Kashmir & hence only allow Kashmiris (and those with Kashmiri
permanent resident certificates) to buy property in Kashmir?
3b. Has there been a racket with hundreds of non-state subjects having
secured permanent resident certificates through dubious means?
3c. Was a Commission set up to study the cases of those who obtained
fraudulent permanent resident certificates?
3d. Is it true that that Commission recommended the termination of the state
subject status attained by the accused on the basis of fraud?
3e. Is it true that most of the complaints 9to the Commission) about these
fraudulently obtained certificates came from the Jammu and Kathua regions
which are "Hindu" regions of Kashmir?
3f. Is there FRAUD going on in Goa - where Gujratis, Punjabis, Biharis and
others are obtaining BOGUS domicile certificates?
3g. Is it true that some of them have even visited the Catholic cemeteries
in Goa and "taken over" the identities of Goan Catholics?
3h. Is it true that Many of these have then secured notarised certificates
that they were Portuguese Nationals on december 19, 1961?
3i. Is it true that most of these FAKE Catholic Goans are now illegally
settled in the UK and France?
3j. Is it true that because of this GENUINE Goan applicants for Portuguese
Nationality (which is their right) are being stifled?
3k. Is it true that GENUINE holders of Indian Certificates are considered
"suspect"?
3l. Is it possible that Kashmiris do NOT want what happened to Goa, to
happen in Kashmir?
(please read the excerpt of DEAD MEN FLYING on http://www.colaco.net )
BTW: I believe the following
1. The law should be fair and equitable. If the laws are the same for EVERY
citizen of a country, then
a: Kashmir should be open to ALL citizens
b. However, IF a contract has been signed before the Accession of Kashmir,
it should be honoured.
c. If Kashmiris do not allow Goans to buy land in Kashmir, Kashmiris should
be barred from holding land in Goa.
How about that ?!
