I was watching the Tucker Carlson show this evening when the scrolling
news flashes the run on the bottom of the screen announced that the
Wisconsin Supreme Court had ruled Marquette University violated John
McAdams' contract when it fired him over statements he made in a blog.
Don't know whether the university will appeal but this is certainly good
news.

scrolled across the bottom of the screen. I've since read the stories and
saw Marquette is not going to appeal. It's a great win for academic
freedom and a body blow to political correctness and groupthink.

Every now and then one of the Good Guys win a Constitutional showdown.
This one was about the very First Amendment to the US Constitution. If it
were not for gutsy citizens like John McAdams our Free Speech would be
merely a dusty relic from the past. Raging Liberals are on a major
assault doing their worst to stamp out any exercise of First Amendment
rights at the University of California at Berkeley. Leftists fear any
Truth they can't mangle or strangle. They react to Logic with fear,
loathing, and hysteria. Too bad, such a pretty campus to be infested with

Hopefully, John will get at minimum back pay and attorney's fees. Not sure
what the law is but it seems fair to me that there should also be
compensation for the turmoil he had to endure. I don't know if punitive
damages can be awarded or not. Seems like they should be.

failure of due process? What about his taking the heat as a champion to
student rights? He defended a college student from being deprived of the
right to academic freedom of speech by a bully of a professor. The abusive

completely.
You're correct. I was mistaken -- that was from the time of the original
suspension: "McAdams was given the chance to return to work after his
suspension, provided he write a letter apologizing for his conduct. The
letter was to be shared confidentially with the student instructor, but
McAdams refused to write it."

The Wisconsin Supreme Court ruled Friday that Marquette University
political science professor John McAdams was improperly suspended after
he publicly criticized a graduate student by name on his politically
conservative blog, leading to threats against her.

In a 4-2 ruling, the conservative-leaning court ordered the Jesuit
university to immediately reinstate McAdams and sent the case back to a
Milwaukee County Circuit Court judge to award damages, including
"unimpaired rank, tenure, compensation and benefits."

McAdams, 72, has been suspended without pay for the past seven semesters.

"The undisputed facts show that the University breached its contract
with Dr. McAdams when it suspended him for engaging in activity
protected by the contract's guarantee of academic freedom," said the
majority opinion written by Justice Daniel Kelly.

In a dissenting opinion, Justice Ann Walsh Bradley said the majority
erred "in conducting only half of the academic freedom analysis."

"It fails to recognize, much less analyze, the academic freedom of
Marquette as a private, Catholic, Jesuit university," Bradley wrote. "As
a result, it dilutes a private educational institution's autonomy to
make its own academic decisions in fulfillment of its unique mission."

Bradley concluded: "Apparently, the majority thinks it is in a better

Universities in the State of Wisconsin. Evidently that concept bothers
two Liberal Judges on the Wisconsin Supreme Court:

The court's two liberal justices dissented, with Justice Ann Walsh Bradley
writing that the majority had failed to recognize the academic freedom of
Marquette as a private, Catholic, Jesuit university.

"As a result, it dilutes a private educational institution's autonomy to
make its own academic decisions in fulfillment of its unique mission,"
Bradley wrote.

Attorney Ralph Weber, who represented Marquette University, said
the Supreme Court's ruling had disregarded the rights of a private
college to make decisions that uphold its values.

not, and most colleges at least *claim* to respect professors' free
speech rights. In the real world, speech the administration doesn't

You've explained the principles well. People often forget that the Bill of
Rights are restrictions on what the government can prohibit. It does not
place restrictions on employers. An employer does have the right to fire
an employee for speech which the employer judges to be harmful to its
business.

We've seen that recently with ABC's cancellation of the revised Rosanne
series. ABC made the judgement that Rosanne Barr's remarks would make
advertisers reluctant to buy commercials which would hurt ABC's bottom
line so a popular show was cancelled.

I would like to read more about this. How is it that private universities
can sidestep the US Bill of Rights? There might be good reasons, but
seems counterintuitive at first glance. Is any private university exempt
or just schools with religious affiliations? The latter would qualify as
a Separation of Church and State, historically considered a good idea by
both sides.

Sounds like it would be theoretically possible for CPUSA to establish
private university that teaches the US Constitution and Bill of Rights a
bad idea that should be ignored, although it would be redundant at this
point in time since Cal Berkley has already adopted that political
philosophy and focussed on rendering the Bill of Rights null and void.
If CPUSA did establish a rival institution they just might be the target
of a lawsuit by Cal Berserkly for copyright infringement.

I was watching the Tucker Carlson show this evening when the scrolling
news flashes the run on the bottom of the screen announced that the
Wisconsin Supreme Court had ruled Marquette University violated John
McAdams' contract when it fired him over statements he made in a blog.
Don't know whether the university will appeal but this is certainly good
news.

I'm always impressed by recorded history and commentary from the Jesuits
and appreciate their intellect, but their brilliance evolved into
arrogance and political intrigue. The Pope had to personally make a visit
to Nicaragua to get the Jesuits to remove their Sandinista berets and act
like real Priests concerned for the salvation of all Catholicism. Pope
John Paul gave them a highly publicized ultimatum to make the choice
between revolutionary politics, or canonical morality for any and all
Catholics, not just the poor.

news flashes the run on the bottom of the screen announced that the
Wisconsin Supreme Court had ruled Marquette University violated John

McAdams, 72, has been suspended without pay for the past seven semesters.
"The undisputed facts show that the University breached its contract
with Dr. McAdams when it suspended him for engaging in activity
protected by the contract's guarantee of academic freedom," said the

In a dissenting opinion, Justice Ann Walsh Bradley said the majority

What ever happened to the Left of Berkeley circa 1964? Mark
They were, in fact, mostly nasty authoritarians who wanted free speech
for themselves, but quickly enough made it clear they wanted to shut
up those who disagreed with them.

The were the same people who thought they had a right to shout down
speakers they didn't like.

There were some honorable exceptions. One researcher I know was part
of the Free Speech Movement, but quickly came into conflict with them
when it because clear they were authoritarians.
