THE ASSOCIATED PRESS
ALLEGAN -- A truck driver who hid his progressive multiple sclerosis
to keep his job has pleaded no contest to vehicular homicide in a
fiery crash that killed an Alma College graduate whom police had
pulled over for a speeding violation.

David Gale, 43, of Ada, Ohio, entered the plea this week during a
hearing in Allegan County Circuit Court.

In Michigan, a no-contest plea is not an admission of guilt, but the
judge treats it the same at sentencing. Gale faces up to 15 years in
prison when he is sentenced Friday.


Early June 23, 2004, Allegan County Sheriff's Deputy Jon Bender pulled
over Emily Van Dyke's vehicle on Interstate 196 near Holland, about a
mile south of where U.S. 31 merges with the freeway. Moments later,
Gale's truck plowed into the back of the police cruiser, then rolled
over Van Dyke's car and dragged it into a ditch, where both caught
fire.

The collision killed Van Dyke, 22, of Saugatuck. She recently had
graduated from Alma College and was preparing to start teaching at a
North Carolina elementary school.

Gale and the deputy suffered minor injuries.

Gale initially told investigators he had fallen asleep behind the
wheel of his rig. Police and prosecutors later discovered that he has
multiple sclerosis.

Medical records show Gale was diagnosed with the disease March 8,
2004, but did not disclose the diagnosis two months later when he
sought to renew his commercial driver's license.

He also persuaded a doctor in his hometown to sign a certificate
stating he is qualified for a commercial license, prosecutors said.

Gale, who was strapped into a wheelchair during his plea hearing, said
he had stopped taking his multiple sclerosis medication before the
crash.

You are a moron on so many levels, it boggles the mind. You got any clue how
expensive it is to have Multiple Sclerosis? The insurance co-pays can range
to the thousands. Think Medicaid/Medicare's gonna pay to take care of this
guy? Think again. Yep, he did wrong, but there was a reason for it-and he
is being punished for it; but his crime wasn't performed with malicious
intent. There's a bus leaving for Cleveland soon, be under it.

Well I have no idea what your name is but the cost of medical care is no excuse to have killed MY SISTER. If you did your research it was not the disease or cost of care that was the issue. The man never told the doctor about the issue when he was renewing his license to drive semi's. So please keep your disgusting comments to yourself until you are fully aware of all the facts around the situation.

Chances are the story, if printed, would have had no impact on anyone
and nobody would even care.

The only reason the story got attention, was the fact a truck driver
was at fault.

FYI, asshole, the DOT physical DOES NOT check for MS.
YOU, the applicant, need only place a check mark beside where it asks
"have you ever had or been diagnosed with MS?".

Is it a lie because you failed to check the box?
Apparently, he failed to check the box because he knew in advance he
would be disqualified to drive.

Yet, you, average joe citizen are allowed to drive your car and kill
someone just the same.
Can you pass a physical as the truckers can?

Think about it, several hundred thousand truckers in this country and
every one of them is physically certified by the DOT to be driving on
the road, while not one damn car driver is.

Thats true, but on the other hand, Florida has me jumping through
hoops every 6-12 months,
eye exams, letters from my doctor, extended road tests which amounts
to four road tests in a row. The last one I got 97 on.. In the last
four years I've had to change my eye glasses one time, for a minor
change to the left lens.
And what does having MS, or high blood pressure, or diabetes if not on
insulin to do with driving?

discussion about the disease its effects and symptoms, and treatment., and
how it has affected me. What started the thread was a truck hater with a
blanket condemnation about something she as usual was totally clueless
about.

A fully loaded rig is 65 feet long or more and weighs in at 80,000

Early June 23, 2004, Allegan County Sheriff's Deputy Jon Bender pulled
over Emily Van Dyke's vehicle on Interstate 196 near Holland, about a
mile south of where U.S. 31 merges with the freeway. Moments later,
Gale's truck plowed into the back of the police cruiser, then rolled
over Van Dyke's car and dragged it into a ditch, where both caught
fire.
The collision killed Van Dyke, 22, of Saugatuck. She recently had
graduated from Alma College and was preparing to start teaching at a
North Carolina elementary school.

Hello, my name is Ian VanDyke, I know this is 12 years later but Emily, was/is my sister. I remember that day like it was yesterday. In the end the driver was pretty much let off the hook and has, maybe still is, living in a nursing home with round the clack care so that he can live a normal life and not be in pain due to his condition. If you ask me he should have been left to rot, but then again I do have a biased opinion on the mater. On that fateful day, not only did I loose my sister but I lost my mother as well. Though my mother is still alive the emotional trauma that she has incurred left her in a place that is not good at all. My mother now suffers from age on set dymentia that got triggered on this day.
