Here we go again, Tom Petty is supposedly issuing a cease and desist
order to Michele Bachman for using "American Girl" at her rallies. We
went through that with Heart back in 2008.

I don't know if we ever got to the bottom of it, but can the artists
themselves actually dictate how their music is used? I'm sure it's a
case by case basis, but in the case of TP and Heart, I'm thinking
those songs are owned by the label or the corporation that owns the
label. I can see how an artist could protest the use, but do they
actually have legal ground to do so?

For the record, all the articles I've found relating to this have been
essentially blogs or gossip columns, although I know Petty supported
Gore back in 00 and it wouldn't surprise me. I've always liked TP
despite his wrong politics. ;)

He was great at SB XLII. icing on the cake that day! I'd think in this
instance that he'd have to have some legal ownership of his song to be
able to legally prohibit Bachman from using the song otherwise it
would be nothing more than a public non-endorsement which for me would
be enough not to use it. Politicians are seedy characters at best, I
know I wouldn't lend my music to any of them.

If the Bachman campaign paid the ASCAP fees for rights of usage,
wouldn't that take care of any obligation? Seriously, I don't see her
using that song as an endorsement from Petty. If he got up on stage
and performed it with her, well yeah, but playing the opening clip
from it? Not so sure.

IMO, it's Petty lashing out because he doesn't want to be associated
with her. I'm not blaming him, and I'd probably have done the same
thing if Obama used one of my songs on the campaign trail. Of course,
I would have done it totally for publicity and not for any other
reason... ;)

I cant blame them for being pissed. They wrote the songs and should have
a right to say who can use it and who cant.
It doesn't matter what part they're in, people are suppose to have
permission to use someone's personal property and songs fit that
description

A nightclub doesn't need to get Tom Petty's permission if they want to play
one of his songs on their PA or if a band wants to perform the song because
they've bought a performance license from ASCAP and probably BMI as well.
The same thing applies to Bachmann's campaign, if they or the venues for
their rallies have ASCAP licenses then they are covered. It's different if
they want to use the song in a campaign ad, then Petty (or whoever controls
those rights) could say no, but he can't keep them from playing the song on
a sound system if they have an ASCAP license. Some performers have been
able to get politicians to stop using their music by making a public stink,
but clearly Michele Bachmann is someone not easily embarrassed.

Tom Petty just doesn't want to piss his fans off that are Dems,
independents, or non political. He understands he could loose money
from certain fans that are dumb enough to align him or his music to
any political party. His only real concern is loosing money. Nothing
more, nothing less.

name recognition and popularity for his wealth..
I don't listen to Petty or anyone else for that matter because of their
political beliefs.
I dont go to concerts to hear idiots like Ted Nugent belittle other
people because of their political beliefs.
I saw Tom Petty 3-4 years ago in Columbus and not once did he belittle
anyone that didnt share his views, which is the way it SHOULD BE.

buddy loved her and came home all pissed off cuz, after driving 30
miles to see her in concert, she wouldn't shut the Hell up and jes
sing her songs. He walked out 1/3rd way through the non-concert.

Hands down, worst concert I've ever seen -- Bob Dylan and Joan Baez.
Dylan did not say ONE WORD... no hello, no goodbye... not a single
word to the audience. Baez never shut up. Unfortunately I had made
the trip with someone else so leaving wasn't an option.

Remember when Madonna did that film bit in the middle of
her 'concerts' do promote some political or charity thing? I'm
no fan, but when she came to Boston, 10% of the crowd
walked out of the show during those videos. It was all
in the local papers. I wasn't there. Yet if one pays damn
danger $$ to see some 'star' they shouldn't be forced to
sit thru that crap. Fans pay to see the show and hear
the music. Not some rant about personal star's issues.

So here goes the cross of music and ideology. Certain performers you
KNOW are gonna be political. Now if you like two or three songs off a
given album and wander in not knowing their bullshit, then you can be
pissed. Write them a letter and ask for your money back.

If you're a die hard fan, you probably dig their ideology and think
that crap is great.

Now we no longer know what sort of license inspired the C&D. For
plain old mechanical licenses, you send your money to Harry Fox,
and nobody can say nothing. SFAIK, Bachmann used the original
recording, so I am not sure what llicense applies - somebody
said "ASCAP?" and my guess is that ASCAP covers it.

That article is a bleeding mess. They don't know mechanicals
from ASCAP from sync.

I smell a business model - high-quality covers, covered
under mechanical license, just for this purpose.

Harry Fox acts as an agent for whoever has the rights. In most cases the
approval is automatic once the fee is paid but nothing prevents a given
artist, label, etc. from putting conditions on approval.

The same applies to ASCAP. They're simply intermediaries in the process.

In this case it would be ASCAP (or BMI, as the case may be), as a
performance license would be required, not a mechanical license (which would
be covered by Harry Fox).

Approval is assumed; the C&D gives notice that the artist wishes the
song not be used. I don't know what happens of the recipient of the C&D
simply blows 'em off. I suspect nothing happens unless the
artists escalates legally.

Something to consider, that song was released in '77. Unless Petty
negotiated rights to his back catalog and it was successful, it would
have fallen into a time when labels DID control content.

Bruce Springsteen successfully had a cease and desist order
carried out on the GOP for using his "Born in the USA" song
at political rallies. He won and the GOP played it no more.
But Springsteen is a card carrying ASCAP member (heh) and he
owns all of his songs - publishing rights, etc and etc.
Come to think of it - without ever playing another gig or
recording anything else - I am sure he could easily live off
the residuals from his song portfolio.

ANyways - sure thing - if the artist owns the rights then
he or she can decide whatever about the song.
The small print though is this: as an artist you can own the
rights to the song - but a label can own the specific publishing right for
a specific recorded version of the song.
So technically you could play and record a song and put it on a CD or album
and the label could own that recorded version of the song. However, you
retain the copyright to the song - you can play it anytime or anywhere but
you lose control of that particular recorded version of the song.

So as an artist you want to try to maintain complete rights to the song
included all 'unique' recorded versions. In a sense you are then using
the label as a contractor to distribute the product and promote it since
the label gets no real big 'backend' profit from it they can be hesitant
about getting into such a situation.

In a lot of cases, big stars (for example in Nashville stables) like
Kenny Chesney own NONE of their songs or publishing rights.
He makes his living through constant tours and a few points on recorded unit sales.
Not a bad way to go though... not bad at all if you hit it big.
But of course he won't even get residuals if he gets songs in heavy rotation
on airwaves.

As I understand it, royalties *are* the main income for the top guns.
Putting on tours is hugely expensive and not the same as you or I doing
a pub gig. Tours promote sales which in turn generate the royalties.

For the recording? Yup. For the song itself? No. I am not
sure if a sync license is required for that application. I
doubt it.

Ultimately the way I read this is that it's a public request to knock
it off that will probably work. I doubt the Bachman campaign would
like to go into the game with a fight with Tom Petty over 90 seconds
of a 45 year old song.

At the same time, if she told him to bring it, the campaign would be
long over by the time a resolution was met, and it's quite possible he
would walk away with nothing but legal bills.

I've been revisiting TP. As you say, he has great hooks. So good, you
lose sight of the complexity of much of his music. It's very layered,
much like ol' Phil Spector's Wall of Sound. But, it comes off like
simple R&R cuz of them hooks. I don't know much about the man. Why
is he a douchebag?

consider Oral Roberts U. as having one of the nation's top law schools.

I also actually work while...working. Weird, huh? But I enjoy what I

What a concept--working WHILE at work. I have a great job too. I've got a

LOL! There's a hell of a lot more to it than just that. And like I've
said before, this isn't all I do to earn an income. Again, I own and
rent homes and property. I'm a freelance photographer. I have
contracts with many of the different surrounding schools that pay very
well to shoot all their students for yearbook annuals, events, and
each kid on a sports team. I'm so booked to photograph many weddings
this summer that I've actually had to start turning people down for
their weddings and other events. Plus I own my own warehouse that
I've turned into a photo studio to shoot scheduled appointments with
clients that want more glamorous or intimate settings with quality
backdrops or props. And no I don't shoot any pornography. I could on
about the many other things I do, but that's enough for now.

No there isn't. You own a small, piss ant record store (or so you
