No, no, no. Section 230 says that Internet companies like Twitter and
Facebook cannot be held liable for posts that individuals place on the
forum they provide. If they could be held liable, the task of
reviewing every word of every post before it would be allowed to go on
the Net would be so onerous they would find another business to be in.
Section 230 is vital.

I have recently read an argument that supports Johnny's conclusion,
although I am not persuaded by it.

But first, there is no tenable argument that the government in creating
Section 230 makes it automatically responsible for private parties that
use the statute to censor speech. It takes much more than an affect to
establish the "state actor" prong necessary to trigger the First Amendment.

The plausible argument I have seen is based on state regulations which
don't permit Twitter to censor posts. In that case, the federal law
preempts the state law, and such preemption *might* be enough to trigger
the state actor prong. On the other hand even if it does, some speech is
censored while other speech rights are enahanced by Section 230, namely
the right not to be compelled to host objectionable speech is enhanced.
I think the courts should butt out when their is an issue between two
competing speech rights, and let Section 230 alone.

parties' rights to fight speech with speech.

complaining. And while this is the government, and comes close to the
line, it still strikes me as speech and poses no First Amendment as of now.

opposition. Some of the more extreme members of your Party would love
to kick FOX News off the air. This is nothing new. Remember the

Rush Limbaugh and conservative talk radio. History repeats itself.

Yes, just as I believe that FOX News and CNN should be able to pick
and choose their broadcasters and content. What can't be permitted is
allowing the government to do the picking and choosing. That is what
the First Amendment is all about, and should be all about. When the
government starts telling Fox or Twitter what they can and cannot
broadcast we are in deep trouble.
How is this different from the attempt by Sinclair Broadcasting to
capture the local broadcasting stations in order to force their right
wing propaganda out to the public?

Sinclair is not the government, just as Fox News, CNN, and the NY
Times are not the government. Never heard you complain about CNN or
the NY Times forcing their left wing propaganda on the public. If
Sinclair is a monopoly, that's why we have antitrust laws.
I agree. But, two of your links are private parties calling for cable
companies to drop Fox, etc. So, you should be defending those private
parties' rights to fight speech with speech.
One of your links describes a letter from two congressman also
complaining. And while this is the government, and comes close to the
line, it still strikes me as speech and poses no First Amendment as of now.
My comments in this thread were not intended to deal so much with the
First Amendment as a tendency of the Left to desire to silence its
opposition. Some of the more extreme members of your Party would love
to kick FOX News off the air. This is nothing new. Remember the
Fairness Doctrine -- nothing more than a failed attempt to silence
Rush Limbaugh and conservative talk radio. History repeats itself.
As you can see from Johnny and the drumbeat against Big Tech, it's a
problem infecting both sides.
Not one I support on my side of the fence, and frankly Johnny does not
speak for anyone but Johnny. Accusations that left leaning news sites
that claim to be non-partisan are not non-partisan are irrelevant.
They can claim what they wish. Fox claimed to be "fair and balanced"
until about two years ago. CNN can claim whatever, I don't care, but
if the Left succeeds in silencing Fox, there will be Hell to pay.

I don't think Fox can be silenced. Government action would violate the
First Amendment. Peer pressure would only strengthen Fox among
conservatives.
