The mistake here is treating things that people choose for themselves as discrimination.
Clearly colour, ethnic origin, sex, orientation (probably) are not something people choose and discrimination on those grounds should be illegal.
OTOH religion, diet, whether one has tattoos etc. are things people choose and why should one be able to make selections on that basis - they could choose to be otherwise. It might be inappropriate as public policy, but it should not be illegal.
