Is Tom DeLay Guilty? Who Cares!

The Republican controlled House of Representatives have voted on a
Rules Change that would allow Texan Tom DeLay to continue on as
Speaker of the House in spite of the fact that Mr. DeLay may be
charged by the House Ethics Committee for various violations.

The new rules would allow Mr. DeLay to continue in the Speakers post
even if he is charged, tried, convicted and sentenced to death for
crimes consisting of but not limited to illegal fund raising, illegal
use of the FAA to track down Democratic rivals, illegal redistricting
of Texas Congressional Seats to benefit Republican candidates, sodomy,
murder, cross dressing, genocide and finally, the illegal use of a
nuclear weapon.

Unnamed White House Source Wegman (Pudgy) Waterhouse, speaking on the
condition of anonymity said, "Sure Tommy has some faults; who among us
doesn't? Except the President of course, don't even start that
crap...he's Gods Anointed even if he does have the occasional Man Date
so I don't want to hear it.

"Anyway, back to Tommy. The point is that Democrats are vicious,
lying, cheating scum who have no compulsion about using something as
trivial as Tom DeLay being indicted for, say, rape and murder against
him for their own political gains. It's not like he supported Abortion
or Gay Marriage or anything, so we're square with the Christian
Fundamentalists. Fundamentalists don't seem to care about breaking
laws as long as we don't use dirty words. Naturally, that doesn't mean
that Dick Cheney has a problem since Christian Fundamentalists also
seem to overlook dirty words too as long as they come from their
candidates.

Mr. DeLay and company have had a bit of a rough year, legally
speaking. Three of Mr. DeLay's top aides have already been indicted in
Texas for breaking laws regarding his fund raising activities. Mr.
DeLay has also been accused of illegally soliciting campaign
contributions, laundering campaign contributions to influence state
legislative races and the improper use of his office to influence
various federal agencies. Rebuked by a House Ethics Committee at the
end of September for pressuring a fellow member of the House to switch
his vote on a health care bill, Mr. DeLay has also been subpoenaed to
give information regarding his use of the Federal Aviation
Administration to track down a plane owned by a rival Texas Democrat
who fled the state rather than allow Mr. DeLay to illegally change
voting district boundaries to aid his fellow Republicans.

Waterhouse, speaking on the condition of even more anonymity said, "I
know that changing the rules to allow Tom to serve even if he's
charged with mass murder just two weeks after the election may look
strange, but think about it: if we waited till Tom was actually in
prison the vote might then have been more difficult. As it is we're
terribly busy installing audio/video hookups to Tom's future prison
cell so he can continue to participate in the Democratic Process even
after sentencing, so it's good to get this done now."

Nancy Pelosi's Ethics Questioned

In what pundits are calling a quid pro quo for her hard line on the ethics
of House Majority Leader Tom Delay, R-Texas, House Minority Leader Nancy
Pelosi, D-Calif., is under fire for an adviser's nine-day, $4,475 junket to
Spain and Germany last April, a trip primarily paid for by a nonprofit
transportation-research organization Pelosi had helped to secure Federal
Transit Administration monies, according to a report in the Washington
Times.



According to the report, the president of WestStart-CALSTART also gave money
to Pelosi's political action committee at the same time.


The trip is fodder for some Republicans, who say Pelosi and others have been
going overboard when criticizing DeLay on ethics charges.


"Given the actions of the minority leader vis-a-vis the majority leader and
other Republicans, I'm having a little trouble finding where the outrage is
coming from these groups that continue to pound on Republican members," a
senior Republican lawmaker said on the condition of anonymity.


Although the Pelosi camp has issued a statement maintaining that the
disputed trip was within House rules, the anonymous lawmaker told the Times
that nothing distinguished Pelosi's actions from those of DeLay and other
Republicans that she has criticized.


"I think the minority leader ought to be subject to the same type of
scrutiny as other members," he said, adding that the questions about Mrs.
Pelosi rise to the point of an ethics complaint.


Apparently there was little attempt at subterfuge - with WestStart-CALSTART
announcing just before the trip that Pelosi had helped the group secure $1
million from the Federal Transit Administration for a bus rapid-transit
program. Furthermore, a month after the adviser's trip, the group dispatched
a press release thanking her for a $2 million grant for a fuel-cell program.


According to campaign records revealed by the Times report,
WestStart-CALSTART Chief Executive Officer John R. Boesel also gave $1,000
to one of Pelosi's political action committees in 2003 and $1,000 to the
Democratic Congressional Campaign Committee.


Boesel said there is no link between the staffer's trip and the grants,
noting that Pelosi had backed his projects for more than a decade. Boesel
also emphasized that the programs in question have drawn support from both
parties and that his political donations have been divvied up to both
parties.

Despite such disclaimers, Ken Boehm, chairman of the conservative National
Legal and Policy Center, which has targeted Pelosi's campaign fund-raising
in the past, said, "I think it looks like she's doing legislative favors for
donors because she is."


The controversy arises as Republicans mount an offensive against what they
think is a coordinated attack by Pelosi and allied groups on DeLay.

KORUSEC in 2003. What's more, Pelosi's office had failed to file the
required financial documentation for the trip until the Washington Post came
looking for it. Other Democrats took part in KORUSEC trips as well.

If Pelosi continues to push for an investigation of DeLay it will backfire
on her and Democrats.

American Public Radio tallied expenditures for so-called "power trips." In
the reported listings, Democrats took 54 percent of such trips, spending
$7,809,837 during 2,730 excursions. Nine of the top 10 spenders and the
entire top five were Democrats. John Breaux led the field with $158,000
dollars spent. Robert Wexler, Gene Green, Maurice Hinchey, and Cal Dooley
round out of the top five, all in the $150,000-dollar range. Jim McDermott
and James Clyburn also made the top 10.

It took the Washington Post several days to acknowledge the bipartisan
nature of these trips. Granted, as House Majority Leader, DeLay does deserve
lead billing in coverage of the story. But to relegate mention of his
Democratic counterpart Nancy Pelosi's comparable involvement to the story's
20th paragraph, the Washington Post made a conscious decision to shift focus
of the story from all connected parties to almost exclusively on DeLay. The
rest of the mainstream media has followed suit.

FEC Fines Pelosi Committees as Result ot NLPC Complaint;
Hypocrisy of "Reformer" Exposed

The Federal Election Commission (FEC) has fined two leadership PACs
associated with House Minority Leader Nancy Pelosi (D-CA) in response to a
Complaint filed by the National Legal and Policy Center (NLPC) on October
25, 2002. The FEC also has fined three campaigns that failed to return
excessive contributions from Pelosi's PACs within 60 days, as required by
law.

Under conciliation agreements reached with the FEC, Pelosi's two
committees - PAC to the Future and Team Majority - will pay $21,000. Julie
Thomas for Congress Campaign Committee (D-IA) and Van Hollen for Congress
(D-MD) will each pay $2,500, and Joe Turnham for Congress (D-AL) will pay
$2,000. The three campaigns also agreed to disgorge $5,000 each to the U.S.
Treasury.

Law Circumvented

In its Complaint, NLPC alleged that Pelosi violated federal election law by
operating two "leadership" political action committees (PACs) in order to
circumvent contribution limits. Members of the Democrat and Republican
leaderships in the House and Senate may legally have one so-called
leadership PAC in addition to their own campaign committee. The purpose of
leadership PACs is to make contributions to the campaigns of other
Congressional candidates.

NLPC's Complaint cited a second circumvention of the law, that of the limits
on amounts donors may give to PACs. Team Majority, the newer PAC, reported
sixteen contributions of $5,000 each from donors who also gave the maximum
to Pelosi's other PAC. Five of the donors gave to both PACs on the same day.

NLPC Chairman Ken Boehm reacted by stating, "We are delighted that the FEC
has acted favorably on our Complaint. No member of Congress has ever set up
a second leadership PAC to evade contribution limits. Pelosi has been caught
violating the clearest and most basic law of all, the limits on
contributions. Talk about hypocrisy."

Within twenty-four hours of NLPC's Complaint, Pelosi announced she would
shut down Team Majority and retrieve contributions already made to
candidates. The PAC made thirty-six contributions to candidates in the
amount of $5,000, the legal limit. Her surviving PAC, which is called PAC to
the Future, distributed $1.7 million to candidates in the 2001-2002 election
cycle.

Sanctimonious Pelosi

Pelosi has been an outspoken advocate of campaign finance reform and
Shays-Meehan, the companion bill to the McCain-Feingold legislation, that
became law. In January 2002, she asserted, "One threat to our Constitution,
indeed to our participatory democracy, is the role of the special interest
money in the political process today."

At an April 2002 kick-off event in San Francisco to the so-called Campaign
Finance Victory Tour, Common Cause President Scott Harshbarger proclaimed,
"The cynics in Washington said we couldn't beat the entrenched power of big
money, and thanks to courageous, independent people like Nancy Pelosi, we
started the job."

Pelosi complained of "extremists in the Republican Party who have repeatedly
tried to undermine campaign finance reform" and of "sneaky tactics employed
by the Republicans" to weaken Shays-Meehan.

Pelosi Gives Twice

Team Majority did not officially exist until October 16, 2002 but had been
raising money since April 2002, and by September 30, 2002 had made donations
to five House and one Senate challenger. Leo McCarthy, the treasurer of both
PACs and the former Lt. Governor of California, candidly admitted to Roll
Call that the "main reason" for setting up the second PAC was to "give twice
as much (sic) hard dollars."

The only defense offered by McCarthy was that he claimed the FEC somehow
approved the improper arrangement in a phone call. He could not, however,
provide the name of the FEC official with whom he allegedly spoke or provide
evidence that such a call occurred. Indeed, it is the FEC's policy that
so-called Advisory Opinions be obtained in writing. McCarthy further
acknowledged that he obtained no legal counsel despite the fact that Pelosi'
s PACs collectively raised over a million dollars.

Pelosi was elected Democratic Whip on November 14, 2002 after Richard
Gephardt (D-MO) announced he would step aside. She was propelled to the post
in part by her ability to raise money for her colleagues. In addition to the
$1.7 million given to Democratic candidates by PAC to the Future, Pelosi
also crisscrossed the country taking part in fundraisers that reportedly
generated over $6 million.

NLPC sponsors the Government Integrity Project. NLPC "blows the whistle" on
government officials and interest groups engaged in questionable activities.
NLPC has filed formal Complaints with a variety of authorities and
regulators, including the FEC, IRS, and Congressional Ethics Committees.
NLPC is strictly non-partisan. Complaints have been filed against Democrats
and Republicans alike.

Nancy Pelosi's Ethics Questioned
In what pundits are calling a quid pro quo for her hard line on the ethics
of House Majority Leader Tom Delay, R-Texas, House Minority Leader Nancy
Pelosi, D-Calif., is under fire for an adviser's nine-day, $4,475 junket to
Spain and Germany last April, a trip primarily paid for by a nonprofit
transportation-research organization Pelosi had helped to secure Federal
Transit Administration monies, according to a report in the Washington
Times.
According to the report, the president of WestStart-CALSTART also gave money
to Pelosi's political action committee at the same time.
The trip is fodder for some Republicans, who say Pelosi and others have been
going overboard when criticizing DeLay on ethics charges.
"Given the actions of the minority leader vis-a-vis the majority leader and
other Republicans, I'm having a little trouble finding where the outrage is
coming from these groups that continue to pound on Republican members," a
senior Republican lawmaker said on the condition of anonymity.
Although the Pelosi camp has issued a statement maintaining that the
disputed trip was within House rules, the anonymous lawmaker told the Times
that nothing distinguished Pelosi's actions from those of DeLay and other
Republicans that she has criticized.
"I think the minority leader ought to be subject to the same type of
scrutiny as other members," he said, adding that the questions about Mrs.
Pelosi rise to the point of an ethics complaint.
Apparently there was little attempt at subterfuge - with WestStart-CALSTART
announcing just before the trip that Pelosi had helped the group secure $1
million from the Federal Transit Administration for a bus rapid-transit
program. Furthermore, a month after the adviser's trip, the group dispatched
a press release thanking her for a $2 million grant for a fuel-cell program.
According to campaign records revealed by the Times report,
WestStart-CALSTART Chief Executive Officer John R. Boesel also gave $1,000
to one of Pelosi's political action committees in 2003 and $1,000 to the
Democratic Congressional Campaign Committee.
Boesel said there is no link between the staffer's trip and the grants,
noting that Pelosi had backed his projects for more than a decade. Boesel
also emphasized that the programs in question have drawn support from both
parties and that his political donations have been divvied up to both
parties.
Despite such disclaimers, Ken Boehm, chairman of the conservative National
Legal and Policy Center, which has targeted Pelosi's campaign fund-raising
in the past, said, "I think it looks like she's doing legislative favors for
donors because she is."
The controversy arises as Republicans mount an offensive against what they
think is a coordinated attack by Pelosi and allied groups on DeLay.

In 2002, Loral Space reached a settlement with the State Department
over charges of passing advanced military technology to the Chinese
Army. Loral agreed to pay $20 million in fines, but did not admit nor
deny wrongdoing.

In 2003, Loral declared bankruptcy. The aerospace giant that sold for
$72 a share in 1996 watched as its shares tumbled to less than 20

Justice Begins Inquiry On China Missile Controversy
In the House, Rep. Cox would lead probe
WASHINGTON (AllPolitics, May 20) -- Justice Department attorneys have begun
an inquiry into what role, if any, campaign contributions played in the
White House's decision to help two U.S. space and communications companies,
CNN has learned.

In turn, the companies allegedly may have helped China improve its military
missile program.

The inquiry, which will involve a massive document review, will be done by a
task force already looking into campaign finance abuses during the 1996
election year.



Sources tell CNN the goal of the inquiry is to see whether a full-scale
investigation into the growing China controversy is necessary. The task
force will be told to forward any information suggesting a need for an
independent counsel probe.

One source told CNN the task force has authority to use a grand jury to
subpoena records, but probably not to call witnesses.

The inquiry will also look at whether the White House decisions had any
relationship to controversial Democratic contributor Johnny Chung.

Chung has told the FBI some of the donations he gave the Democratic National
Committee came from Chinese aerospace officials who had ties to China's
military.

Senior Justice officials maintain that no specific allegation of wrongdoing
by President Bill Clinton has yet surfaced. Some FBI officials, however,
privately believe the independent counsel review process should begin and
they believe a more aggressive approach should be in place to get to
witnesses immediately. However, Justice sources say the FBI has not raised
those concerns in meetings about the issue.

The inquiry was launched Monday, sources say, but was given additional
guidance on what to seek following a meeting Wednesday.

Rep. Cox would lead House inquiry
In another development, Rep. Chris Cox has confirmed he has been selected by
House Speaker Newt Gingrich to chair a proposed special committee to
investigate possible national security violations in the sale of U.S.
missile technology to China, as well as possible attempts by the Chinese
military to influence the U.S. election process.


Cox said the proposed inquiry would be broad and involve the jurisdiction of
many House committees.

"It would make sense to consider, and this is only under consideration, a
committee that would be focused on the subject matter rather than on a
corner of it within the jurisdiction of one of our committees," said Cox, a
California Republican and China authority.

The entire House will vote on the proposed committee when Congress returns
from its Memorial Day recess.

Gingrich has said the inquiry is about national security, not campaign
fund-raising, but the two are destined to converge should the proposal come
to pass.

Gingrich offered the idea of a select committee in response to allegations
the Clinton Administration gave special treatment to Loral Space and
Communications in its sensitive dealings with China's space agency.


Loral's chief executive officer, Bernard Schwartz, is a major Democratic
donor.

President Clinton signed a waiver allowing Schwartz's company to sell
missile technology to China over the objection of the Pentagon. Loral denies
any improprieties.

Gingrich's plan is to make the new select committee similar to the one
chaired by Sen. Sam Ervin in 1973 during the Watergate scandal, but this one
would have five Republican and three Democratic members.

The White House voiced skepticism about the proposed new committee, but said
it would work with Congress in any event. "That's their business, not ours,"
said White House spokesman Mike McCurry.

Strong words on House floor
Meanwhile, the House debated several amendments to the Defense Authorization
Act designed to pressure the White House to reveal what happened regarding
the export of satellite technology to China.

Republicans said the issue was national security.

"One would think common sense tells us that we should not send any of our
defense-related technology or equipment to the only remaining communist
country in the world that maintains a nuclear capability," said Rep. Joel
Hefley (R-Colo.).

Republicans challenged Democrats. "My colleagues on the other side of the
aisle need to be patriots first and politicians second, patriots first and
politicians second," said Rep. Dan Burton of Indiana.

In fact, with heavy Democratic support, the House rammed through a series of
just-drafted amendments that would prohibit sharing U.S. satellites or
missile technology with China.

"You know, of all the scandals coming out of the White House, this scandal
is perhaps the most disturbing of all," said Rep. Mark Neumann (R-Wisc.)

Democrats say they are disturbed by the politics of it all.

"Is there a single shred of evidence that suggests this president took the
money, knew what he was doing and then said 'send the missiles, send the
satellites to be on the missiles because of the money?' " asked Rep. Robert
Wexler, a Florida Democrat. "Not a single shred of evidence. It's
treasonous, they say, without a single shred of evidence."

Many Democrats are not in love with the idea of a new select committee, but
House Minority Leader Dick Gephardt told CNN he would go along reluctantly.

"If this is his [Gingrich's] final decision, we have to cooperate and will
cooperate because we want the investigation to go on," Gephardt said.

Scores of Republicans are sending a letter to Clinton, urging him to cancel
his trip to China next month.

"The president has no business jetting off to Tiananmen Square to attend
ceremonies with China's communist leaders," said Rep. Sue Myrick (R-N.C.)

In the Senate, the matter will be investigated by the existing Intelligence
committee. Senate Republicans are taking a lower key approach than their
House counterparts.

White House: No plans to cancel China trip
The latest allegations of Chinese influence-buying come only five weeks
before Clinton's scheduled visit to China, he first such visit by an
American president since the Tiananmen Square uprising in 1989.

Despite Republican calls to cancel the trip, the White House says the
president is not even considering that.

"We're going there despite all the differences we have with the People's
Republic to try to work constructively to improve this relationship which is
so important to billions, literally billions of people," said McCurry.

After a slow start, the White House damage control team is taking the
offensive. White House counsel Charles Ruff sent a letter to Republican
leaders Wednesday, insisting Clinton was simply doing what both Presidents
Reagan and Bush had done in allowing U.S. satellites to be launched from
Chinese missiles.

But Republicans charge the Clinton Administration went further, authorizing
Loral Space and Communications to continue such deals even while the Justice
Department was investigating Loral for allegedly supplying China with
embargoed missile guidance systems.

"They knew these communications satellites were one of America's most
sensitive military and intelligence gathering technologies," said Rep. Jim
Gibbons (R-Nev.) "Was there some other issue driving this change? America
deserves to know the answers to these questions."

The allegations could prove more explosive than those involving Whitewater
and Monica Lewinsky.

"I don't think they [the White House] can use the standard procedure of
delay or the standard procedure of attacking their attackers," said Stephen
Hess of the Brookings Institution. "I think they have to deal with this
because this is probably the first charge in the campaign finance deal that
the American people will want, if not demand, an answer to."

Was Pentagon opposition squashed?
Meanwhile, Republican congressional staffers told The Associated Press that
Pentagon staffers who reviewed a Loral export license were kept from voicing
opposition to Clinton's approval of the transfer of satellite technology to
China.

Three Republican congressional staffers, who asked not to be identified,
said more than one worker at the Pentagon's Defense Technology Security
Administration, reported that its head, David Tarbell, told subordinates
before the decision in February that the president had already reached a
conclusion on what to do.

Committee investigators quoted staff at the agency as saying they were
drafting memos in late 1997 and early this year opposing the export license
for Loral but Tarbell told them not to submit their work and to erase draft
memos.

Tarbell, a career civil servant, issued a statement denying the allegations.

"I have no recollection of telling anybody on my staff not to oppose the
license or the waiver in this case," Tarbell said. "I had no idea in advance
whether or not the president was going to grant the waiver. Any report that
I asked people to eliminate or destroy documents of any kind on this matter
is absolutely wrong."

A unanimous vote on immunity
In another development, the House voted 402-0 Tuesday night to support
immunity for prosecution from four prospective witnesses for Rep. Burton's
campaign fund-raising inquiry.


The four are associates of Chung, the man at the center of the controversy.
The Democrats later returned Chung's $366,000 in contributions when they
could not confirm the money's source.

The unanimous vote for the non-binding resolution gained the support of
Democrats who said they would not vote to actually grant immunity as long
Burton continued to head the inquiry.

Democrats on the House Government Reform and Oversight Committee, which
Burton chairs, have blocked the immunity grant to protest what they claim is
Burton's partisanship in running the investigation.

Nancy Pelosi's Ethics Questioned
In what pundits are calling a quid pro quo for her hard line on the ethics
of House Majority Leader Tom Delay, R-Texas, House Minority Leader Nancy
Pelosi, D-Calif., is under fire for an adviser's nine-day, $4,475 junket to
Spain and Germany last April, a trip primarily paid for by a nonprofit
transportation-research organization Pelosi had helped to secure Federal
Transit Administration monies, according to a report in the Washington
Times.
According to the report, the president of WestStart-CALSTART also gave money
to Pelosi's political action committee at the same time.
The trip is fodder for some Republicans, who say Pelosi and others have been
going overboard when criticizing DeLay on ethics charges.
"Given the actions of the minority leader vis-a-vis the majority leader and
other Republicans, I'm having a little trouble finding where the outrage is
coming from these groups that continue to pound on Republican members," a
senior Republican lawmaker said on the condition of anonymity.
Although the Pelosi camp has issued a statement maintaining that the
disputed trip was within House rules, the anonymous lawmaker told the Times
that nothing distinguished Pelosi's actions from those of DeLay and other
Republicans that she has criticized.
"I think the minority leader ought to be subject to the same type of
scrutiny as other members," he said, adding that the questions about Mrs.
Pelosi rise to the point of an ethics complaint.
Apparently there was little attempt at subterfuge - with
WestStart-CALSTART
announcing just before the trip that Pelosi had helped the group secure $1
million from the Federal Transit Administration for a bus rapid-transit
program. Furthermore, a month after the adviser's trip, the group dispatched
a press release thanking her for a $2 million grant for a fuel-cell program.
According to campaign records revealed by the Times report,
WestStart-CALSTART Chief Executive Officer John R. Boesel also gave $1,000
to one of Pelosi's political action committees in 2003 and $1,000 to the
Democratic Congressional Campaign Committee.
Boesel said there is no link between the staffer's trip and the grants,
noting that Pelosi had backed his projects for more than a decade. Boesel
also emphasized that the programs in question have drawn support from both
parties and that his political donations have been divvied up to both
parties.
Despite such disclaimers, Ken Boehm, chairman of the conservative National
Legal and Policy Center, which has targeted Pelosi's campaign fund-raising
in the past, said, "I think it looks like she's doing legislative favors for
donors because she is."
The controversy arises as Republicans mount an offensive against what they
think is a coordinated attack by Pelosi and allied groups on DeLay.
