A Federal Appeals Court has ruled atheism to be a religion.
The 3 judge panel cited, as precedent, an earlier Supreme Court ruling on the issue.

Those judges are home schooled idiots who could not understand what is religion???

From your link:
It is difficult not to be somewhat jaundiced about our courts when they take clauses especially designed to protect religion from the state and turn them on their head by giving protective cover to a belief system, that, by every known definition other than the courts’ is not a religion, while simultaneously declaring public expressions of true religious faith to be prohibited,” Fahling said.

The ruling is here:

Note the date:

United States Court of Appeals,Seventh Circuit.

James J. KAUFMAN, Plaintiff-Appellant, v. Gary R. McCAUGHTRY, et al., Defendants-Appellees.
No. 04-1914.
Decided: August 19, 2005

Arty Joe isn't giving us news, but history.

People who aren't prisoners are allowed to join explicitly
atheist organizations, or religious ones - Unitarian Universalists,
Ethical Culture Society - which do not require belief in a deity.

In his pleading, Kaufman specifically mentioned "humanism."
While at Waupun, Kaufman submitted an official form titled “Request for
New Religious Practice,” in which he asked to form an inmate group
interested in humanism, atheism, and free speaking.   The group would
work “[t]o stimulate and promote Freedom of Thought and inquiry
concerning religious beliefs, creeds, dogmas, tenets, rituals and
practices[, and to] educate and provide information concerning
religious beliefs, creeds, dogmas, tenets, rituals, and practices.”
See Kaufman v. McCaughtry, 2004 WL 257133, *4 (W.D.Wis. Feb.9, 2004).
Kaufman also submitted a list of atheist groups and literature.   The
officials concluded that Kaufman's request was not motivated by
“religious” beliefs.   Accordingly, rather than evaluating the
proposal under the state's relatively more flexible policy for new
religious groups, see Wis. Admin.   Code § DOC 309.61, they considered
it under the procedure for forming a new inmate activity group, see
Wis. Admin. Code § DOC 309.365.   Applying the latter standard, they
denied the request, stating that they were not forming new activity
groups at that time.
Further down, the court explains it is only considering atheism as
a religion in a "...specialized sense....."
But when the underlying principle has been examined in the crucible
of litigation, the Court has unambiguously concluded that the
individual freedom of conscience protected by the First Amendment
embraces the right to select any religious faith or none at all.
and again
Indeed, Torcaso specifically included “Secular Humanism”
as an example of a religion.  Id. at 495 n. 11, 81 S.Ct. 1680.
The humanists, secular or otherwise, have their own organization:

http://americanhumanist.org/

It is plain that, inmates who wanted to set up a bible study group,
perhaps supported by one of the chaplains serving the prison, or
a group studying another faith, would have privileges atheist
inmates would not have access to, unless they faked interest in
studying some religion.

For the record, IANAL. I was never even a naval officer tasked
with legal duties by his CO when no lawyer was available.
I do know how to use a search engine, and citing the name of the
case, and the opinion is extremely easy in this day and age.

Wikipedia has an article on the Torcaso case, which mooted any
state laws requiring a religious test for office.

https://en.wikipedia.org/wiki/Torcaso_v._Watkins

1st, your posts are trolls. You bring nothing positive to the groups.
This has been pointed out to you repeatedly, but you continue to post
merely, one presumes, to be vexatious. Unlike our fundie Christian
and Catholic posters, you aren't (yyou say) trying to win converts for
Judaism. You do seem to be trying to get people to accept positions
consonant with some faith, as if you think all the goyim ought to
have some religion. The old "Christianity isn't true, but it is
better for the Jews if the pagans became sorta monotheists" may apply
here. In medieval times it might have been "better for the Jews" of
people converted from pagan to Islam. Times change.

2nd, what is the point of reposting arguments that have already
been hashed out, starting from square one all over again? It wouldn't
be because you got you logical ass kicked, and instead of reviving the
old thread and rebutting said ass-kicking, you prefer to spread your
disinformation in front of those who didn't follow the old argument,
and fool them, would it? That's not going to work. You will be called
on your PRaTTs.

Look at the positive side. You can set up your basement as a "chapel",
have fellow atheists over to attend "services", and pass the collection
plate around. If atheism is a religion then you should have no problem
writing off your basement chapel and the money you've collected.

Oh, and you also have every right to complain about religious persecution

Can anyone prove the IRS and the courts will allow a tax exemption
for a "house church?" If the people who meet at the house are
incorporated as a religious society, that society could be tax
exempt, but a homeowner who hosts the meeting trying to take a deduction,
as if it were a home office, is probably not going to fly.

Home office deduction rules are pretty strict. Any dual use
could ruin your chance for the deduction.

I am neither an accountant nor a lawyer, so get professional advice
if you try any of this.

offerings of beer and pizza!
Maybe we could add bong hits as well?
Can anyone prove the IRS and the courts will allow a tax exemption
for a "house church?" If the people who meet at the house are
incorporated as a religious society, that society could be tax
exempt, but a homeowner who hosts the meeting trying to take a deduction,
as if it were a home office, is probably not going to fly.
Home office deduction rules are pretty strict. Any dual use
could ruin your chance for the deduction.
I am neither an accountant nor a lawyer, so get professional advice
if you try any of this.
Incorporate the church "body" as a religion, with yourself, your
spouse, and your eldest child as CEO, CFO, and Secretary of the Board
(of three persons), sell the house to the religion for $1.00
(declaring the loss against any capital gains you might have), and
deduct ALL of the expenses of the house (heating, lighting, repairs,
general upkeep, etc.) forever after. Remember to register the church
with your local authorities to get those pesky real estate taxes
removed, too.

It is difficult not to be somewhat jaundiced about our courts when
they take clauses especially designed to protect religion from the
state and turn them on their head by giving protective cover to a
belief system, that, by every known definition other than the
courts’ is not a religion, while simultaneously declaring public
expressions of true religious faith to be prohibited,” Fahling said.

You know full well that atheism is not a religion.
Look at the positive side. You can set up your basement as a "chapel",
have fellow atheists over to attend "services", and pass the collection
plate around. If atheism is a religion then you should have no problem
writing off your basement chapel and the money you've collected.
Oh, and you also have every right to complain about religious persecution
from assholes like Mad Joe.
...and all the fun of a church gathering without the guilt of sin,
fear of hell and long winded, boring, pointless god infested sermons.
Halle-fucking-luyah ! Pass the beer and pizza !
Pizza, the ultimate communion wafer with some actual nutritional
value! What's not to like?

Yep. That's his shtick.

In those stubborn cases, the best remedy is to drive home

might get it!

The court says atheism is a religion but he doesn't give any context.

He tries to be creative in the way he lies.

But that would require a kind of intelligence he simply doesn't possess.

He just keeps plugging away at showing the world how desperately he and his the other theist trolls are but forgets that his actions are so transparent that the result is he helps create more atheists.

What a schmuck.

That settles it then!

If the Christers can have their plastic jesus, then by
golly, it's only fair that we get to have our own savior.
And what better savior for an atheist could there be, than
an anthropomorphized goddess of evolution -- with a slight
"titty twist", that is!

I shall dub her: "Eve-o-lution"!

And from her ample lactating brests, shall flow rivers of
milk to nourish the soul-less masses. There will be no more
hunger! Nor will there be pain! (as all taps will be spiked
with Laudanum)

Hell, why settle for only two "taps"?

If the Hindus can have gods with N arms, why the hell can't
we have N breasts? I'm mean -- fuck -- what good is N arms
anyway when you've only got one dick? "Ghad" -> scmhod! Have
they no concept of pragmatism? It boggles the mind!!!

Think about it...

* Craft beers

* Cabo Wabo Margaritas

* Black toothed grin

All on tap.

Open bar man!

Open bar!!!

A Federal Appeals Court has ruled atheism to be a religion.
The 3 judge panel cited, as precedent, an earlier Supreme Court ruling on the issue.
According to the logic of your "federal court of appeals" not playing
baseball or basketball or any other sport is a sport. To label
non-belief as its own religious belief is simply stupid, and I guess
that you, Joe, yet again has absolutely no point you want to make.

We dealt with this story a few years ago (and the article is 12 years
old, by the way).

None of them are atheists. And, they obviously don't care what atheists think, so they are biased. Atheists know that atheism is NOT a religion. But, now that
atheism has been legally declared a religion, any atheist group can claim tax breaks. Of course we won't, because our political freedom is more important than cash. And, any group that takes the tax break can donate it or part of it to those groups that don't. So, either way, we win.

You can only claim tax exemption if you are registered with the IRS as a
charity.Go ahead and apply.

The point of the ruling is that atheists must enjoy the same rights as
theists--they may not be discriminated against any more than a
recognized church may be.

And of course, as we all know, profound theological and philosophical issues,
ones that have engaged the best minds for millennia, are easily put to rest by
the legal system.

In fact it is rumored that the Supreme Court will be taking up both
the Problem of Evil and the Euthyphro dilemma in its next session.

The judges are idiots, but atheists should be accorded the same rights
as religions. They are doing the right thing for the wrong reason;
and it will come back to bite them (or us) someday.
