Begging the Queen's pardon

Fake President Drumpf's disgusting pardon of the criminal monkey commonly referred to as Sheriff Arpaio prompted me to wonder - does the Queen have the power to pardon a criminal?

Short answer "Yes", but it is nowadays only exercised under advice from her Ministers. As "advice" is a two-way affair, she could theoretically advise her Prime Minister on a Tuesday audience that so-and-so should be pardoned.

The Royal Prerogative of Mercy is still exercised in Australia although it should be noted that it does not overturn a conviction, only alters the consequences. Possibly the last time the Power was exercised here was in the Azaria Chamberlain case, where Mrs. Chamberlain was convicted of murder in the Northern Territory when in fact it was a dingo who took her baby. She was Pardoned and then later the conviction was overturned in the Courts.

In the U.K., as far as I can gather the last time the Royal Prerogative was exercised was in 2013 when the late Alan Turing was Pardoned posthumously. He had been convicted in 1952 of gross indecency under the laws prosecuting homosexuality.

It seems likely that it would only be used in uncontroversial cases. These days it seems unlikely that the Home Office, or whoever in government, would recommend to the Queen that a current decision by a British court be questioned, which is ultimately what a pardon is about. The Turing case seemed to get wide, although not total approval, as it should have done when you consider his fate.

The dingo case will remain a blight on Australian justice.

It seems likely that it would only be used in uncontroversial cases. As we are not privy to what goes on at audiences the Queen has with her Ministers - or her 'phone calls to those ministers in her other realms, we will never know what advice she herself has given rather than received. It could be that she is much more involved than we ever expected. We do know that she follows what is going on quite intently.

Of course,there can be no legal power the Queen does not have...
but in practice,it's "exercised on the advice of the Home Secretary",
which means you submit your application to some bureaucrat in the
Home Department and hope.
