EXCEPT that the judge has previously instructed me to not

crime suspect's seat.
It had been seized by me totally legally, but now
this judge had decided that it's existence was too
inflammatory, and it would unduly influence the jury, and
thus deny the suspect his chance to a fair trial!

Legal maybe, but in church? :-)

If it's there, isn't it evidence? The defendant may not like
having their personal property legally searched, and shown around,
but that's hard luck.

Yes.
The victim had not described him as having handcuffs
when he tried to grab her. So, those items intended
use was speculation. And, yes, very prejudicial and
inflammatory.

As I did with everything else, I listed it all in my
report and discussion with the prosecutor.
Because the grabbing (attempted kidnapping) was so inept,
he chose to only charge for exposing and assault.
He did want the items from under the seat admitted,
and a long discussion and recess to study further ensued.
The prosecutor was also irritated when the judge ruled
against them.
(To be more clear with your question - that was up to the
prosecutor to try, and the judge to decide,
in other words - not my job man!)
