records to an ICE agent unless the ICE agent either 1) has a warrant
or 2) federal law permits the ICE agent to gain access.
that violating their 4th amendment right to allow a search that the
Supreme Court says we have, and that's why we often see police asking if
they can search your car or pockets your house your business.... This
would mean that every time a California State or local law enforcement
officer does a search without a warrant it's illegal.
Because the USSC says you have a RIGHT to allow a search? Sorry you
can't have it both ways, it can't be both a right and NOT a right under
the U.S. Constitution.
Personally I've said for years that a person can't give permission for
the Government to break a law that prohibits the government "by law"
from searching. that permission is meaningless so in the end California
might prove my point and make all their warrant-less searches illegal
thus emptying out the prisons of all the people that said yes to
allowing California police to search them illegally.
I'll be rooting for California to make this happen so that all
warrant-less searches are illegal and every single search is done with a
warrant in the hands of the police doing that search.
